‍Thewebsite lumeen.com (hereinafter the “Site” ) is owned by Lumeen, a simplified joint-stock company with a capital of €20,000, registered with the Lyon Trade and Companies Register under number 850 173 535, with its principal place of business located at 4 rue de la République – 69001 Lyon (hereinafter referred to as “Lumeen” ). Use of the Site is subject to the review, acceptance, and compliance with these Terms of Use (hereinafter the “Terms” ) by all users browsing the Site (hereinafter the “Users” or “you” ).

‍Article 1: User Obligations

‍Inany case, you may use the service only for lawful purposes, that is, in compliance with all applicable laws and regulations.

In particular, you agree not to use the Site in any way that could infringe on the rights of others; not to use software or any other device to interfere with or attempt to interfere with the proper functioning of the Site, whether manually or electronically, by any means whatsoever; not to upload or make available files containing corrupted data or viruses; not to alter, modify, or degrade the Site’s graphic design or the software code comprising it; not to take any action likely to result in unreasonable or disproportionate traffic on the Site or on any infrastructure related to the Site; and not to obtain or attempt to obtain unauthorized access to any of our networks or systems by any means whatsoever.

‍TheSite is accessible 24 hours a day, 7 days a week; however, Lumeen cannot guarantee uninterrupted operation. Lumeen reserves the right to suspend the Site for technical maintenance necessary for its proper functioning or to update the Site.

Without prejudice to any other rights, Lumeen reserves the right to deny you access to the Site if it determines that you are not complying with any of the provisions of these Terms of Use.

The Terms of Use may be modified at any time and will take effect immediately upon being posted on the Site.

‍Article 3: Intellectual Property

‍Thegeneral structure of the Site, as well as the software, text, images (whether animated or not), icons, sounds, and all other elements comprising the Site, are the exclusive property of Lumeen.

Any representation or reproduction, in whole or in part, of the Site without the express prior authorization of Lumeen is prohibited and would constitute an infringement punishable under Articles L.335-2 et seq. of the Intellectual Property Code.

The trademarks of Lumeen and its partners, as well as the logos appearing on the Site, are registered trademarks. Any reproduction, in whole or in part, of these trademarks or logos based on elements of the Site without the express authorization of Lumeen is prohibited.

The photographs and illustrations on the Site are for illustrative purposes only and do not, in any way, constitute a binding commitment on the part of Lumeen.

Decompilation (reverse engineering), disassembling, or otherwise reducing the code used in any software on the Site to a human-readable form in order to examine its structure and/or to copy or create other products based (in whole or in part) on such software is prohibited, except where required by mandatory law (as provided for in Article L.122-6-1 IV of the Intellectual Property Code).You may not use meta tags or any other hidden text containing the name “Lumeen” without Lumeen’s specific, prior, and written consent.

Any hyperlink to the Site using framing, automatic hyperlinks (“in-line linking”), or deep linking is strictly prohibited.

‍Article 4: Lumeen's Liability

‍Lumeenstrives to provide reliable content, but despite the care taken in writing the text and selecting the photographs, errors may occur.

Lumeen shall not be held liable for any direct or indirect damages that may result from the use of the information provided on the Site.

Accordingly, you acknowledge that you use this information at your own risk and are encouraged to conduct any necessary due diligence.

Lumeen shall not be held liable for any difficulties in accessing the Site or any temporary inability to access the Site resulting from maintenance, disruptions to the telecommunications network, or the actions of a third party.

‍Article 5: Disputes

‍Onlythe French-language version of the Terms of Use is binding between the parties and may be submitted in court.

The Terms of Use are governed by French law. In the absence of an amicable resolution of any dispute between you and Lumeen—and provided that you are acting in a professional capacity—exclusive jurisdiction is conferred upon the courts of Paris, including in cases involving multiple defendants, third-party claims, and emergency proceedings.
